Jury finds McAllen oral surgeon not guilty in Medicaid fraud case

McALLEN — Jurors acquitted a local oral surgeon on federal charges that he led a conspiracy to file false Medicaid insurance claims.
Dr. Gary Morgan Schwarz stood accused of one count of conspiracy and seven counts of health care fraud in U.S. District Court in McAllen.
The trial lasted eight days and went to the jury late Wednesday afternoon. Nearly two days later, jurors cleared Schwarz on all eight counts.
Schwarz's lawyer, Tony Canales, said his client is "very happy" with the outcome in the case.
"The government was wrong from day one," Canales said. "They were wrong in the way they treated Dr. Schwarz. They were wrong the way they executed search warrants. He was never given the opportunity to explain himself."
